    Default Am I breaking a Copyright law if....

    I have a littlie weird question.

    If I photograph a statue by some known artist, that is placed in a public property, and then sell this photograph, am I breaking the copyright laws?

    I would say no your not. If it is in public and visible you can shoot it, print it and sell it if you can or want to .

    Thabk you, that was what I was thinking, but you never know with all of the legal mumbo jumbo, I just wanted to be sure.

    What does that law.. umm the one (I think in 1990) where buildings are copyrighted... can you still sale images? I think Tegan and I talked about this one in a post.

    It refers to buildings built past a certain date are capable of being copyrighted and you need permission to sale or publish them... not sure. I don't really remember, but maybe this will be seen by someone who does.

    I recall that discussion but it would never hold up in court, the law if I recall is an American one, but I don't believe it was ever validated by a court decision, anyway just my opinion. I would not worry about it, I personally would do it so all I can say.

    I know that in Canada if you take a photo of a copyrighted building and sold it, you are infringing on copyright laws. I know that in Nova Scotia a photographer took a photo of the Bluenose II and sold the photos. The Bluenose II society found out about it and it went to court, but it gone thrown out. Not sure why though.
