Though not technically legal, the cops tend to turn a blind eye to this sort of thing and focus on the dealers. This makes complete sense to me. Why waste tax dollars dragging people through the court system for smoking pot? At one point they were playing with legalization but I believe president Shrub gave them the ultimatum and it all went south
